Terms and Conditions
Effective Date: April 2026
These Terms and Conditions (“Terms”) govern your access to and use of all services provided by AndHeal™ (“we,” “our,” or “us”), including the andheal.com website, the AndHeal Signal Index™ hosted at assess.andheal.com, any AI-generated reports, educational materials, and related services. By accessing or using any part of our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
These Terms should be read together with our Privacy Policy & Disclaimer, which describes how your data is collected, processed, and stored. Where these Terms and the Privacy Policy address the same subject, both apply. In the event of a direct conflict, these Terms govern.
1. Definitions
“Assessment” means the AndHeal Signal Index™, a structured educational instrument consisting of questions about your biological patterns, lifestyle, stress history, dietary context, and related topics, accessed through assess.andheal.com or any successor URL.
“Report” means the personalized biological profile report generated by an artificial intelligence system based on your Assessment responses, including your assigned profile, domain scores, narrative analysis, and Phase 1 Plan of Actions.
“Services” means all offerings provided by AndHeal, including the website, the Assessment, the Report, educational content, Plan of Action sessions, and any related programs or materials.
“You” or “User” means any individual who accesses the website, begins or completes the Assessment, receives a Report, or otherwise engages with AndHeal’s Services.
2. Nature of Services
Educational Framework
AndHeal provides biology-informed education, structured insight, and strategic wellness guidance. All Services are educational and informational in nature. AndHeal does not provide medical diagnosis, clinical assessment, treatment, or therapy. Donna O’Connor is not acting as a licensed healthcare provider in the context of AndHeal engagements.
No Professional Relationship
Your use of any AndHeal Service, including the Assessment and Report, does not create a physician-patient, therapist-client, advisory, fiduciary, or consulting relationship between you and AndHeal, its founder, or any of its practitioners. You acknowledge that AndHeal’s Services are educational tools designed to support your awareness and decision-making, not to replace independent professional judgment.
Not a Substitute for Professional Care
The information, guidance, and recommendations provided through AndHeal’s Services are not a substitute for professional medical advice, diagnosis, or treatment. You should consult your physician or other qualified health provider with any questions regarding a medical condition before making changes based on information received through AndHeal.
3. The AndHeal Signal Index™
What the Assessment Is
The Assessment is a structured educational instrument that collects self-reported information about your biological patterns, lifestyle, stress history, sleep, digestion, cognitive function, hormonal experience, dietary context, and investment readiness. It is designed to help you see your own patterns with greater precision and to generate a personalized Report.
Consent and Data Processing
Before beginning the Assessment, you will be asked to provide explicit consent to the collection, processing, and storage of your responses as described in our Privacy Policy. This consent is required to proceed. By beginning the Assessment, you confirm that you have read and understood the Privacy Policy and that you consent to your data being processed using an AI system to generate your Report, your completed Report being generated as a PDF and stored securely within AndHeal’s own infrastructure using a third-party conversion service that does not retain your data, your Report being delivered automatically by email to the address you provided, your data being stored across the platforms described in the Privacy Policy, and a copy of your Report being received and reviewed by AndHeal’s practitioner team for session preparation.
Accuracy of Your Responses
You are solely responsible for the accuracy, completeness, and honesty of the information you provide in the Assessment. The quality and relevance of your Report depends entirely on the quality of your self-reported responses. AndHeal does not independently verify any information you provide and is not responsible for inaccuracies in your Report resulting from incomplete or inaccurate responses.
4. AI-Generated Report
How the Report Is Generated
Your Report is generated by an artificial intelligence system that reads your Assessment responses, applies AndHeal’s proprietary scoring methodology, and produces a personalized narrative. The AI system operates under guidelines designed to reflect AndHeal’s biology-informed methodology. Upon completion of the Assessment, the Report is automatically converted to PDF format using a third-party conversion service that does not retain your data. The completed PDF is stored securely within AndHeal’s own infrastructure and is delivered automatically by email to the address you provided when beginning the Assessment. The PDF filename contains no personally identifying information.
Limitations of the Report
The Report is an educational tool. It is not a medical assessment, clinical evaluation, diagnostic instrument, or professional opinion. The Report is based entirely on your self-reported data and an AI system’s interpretation of that data. AndHeal does not guarantee the accuracy, completeness, suitability, or applicability of the Report to your individual circumstances.
You acknowledge that AI-generated output may contain errors, may not capture all relevant factors, and should not be relied upon as the sole basis for decisions about your health, performance, or wellbeing. The Report is one input among many you should consider, including consultation with qualified professionals.
Use of the Report
Your Report is generated for your individual, personal, educational use only. You may not redistribute, publish, sell, license, or commercially exploit your Report or any portion of it without prior written permission from AndHeal.
You may not represent the Report as a medical assessment, clinical evaluation, or diagnostic document. You may not present the Report as having been prepared by a licensed healthcare provider.
If you share your Report with others, you do so at your own discretion and risk. AndHeal is not responsible for how third parties interpret or act upon information contained in your Report.
Report Delivery and Authorization
Upon completion of the Assessment, your Report is delivered automatically by email to the address you provided. You are responsible for providing an accurate email address that you are authorized to use. By providing an email address, you confirm that you have the right to receive communications at that address.
If you request a copy of the Report after initial delivery, you will be asked to confirm that you are the person who completed the Assessment or have the authority to receive the Report, and that the email address you are providing is yours or is authorized to receive the Report. This confirmation is required before a copy is sent.
AndHeal is not responsible for delivery of the Report to email addresses you designate that are incorrect, inaccessible, or not under your control.
5. User Responsibilities
By using AndHeal’s Services, you agree to the following:
- You will provide accurate and honest information in the Assessment
- You will not misrepresent the Report as a medical, clinical, or diagnostic document
- You are solely responsible for how you interpret and act upon the information in your Report and any guidance provided through AndHeal
- You will consult qualified medical professionals before making health-related decisions based on information from AndHeal
- You will not use the Services for any unlawful purpose or in any manner that could damage, disable, or impair the Services
- You will not attempt to gain unauthorized access to any systems, accounts, or data associated with the Services
6. Intellectual Property
All content on the AndHeal website and within the Services, including text, graphics, logos, design elements, assessment questions, scoring methodology, profile frameworks, report templates, and educational materials, is the property of AndHeal unless otherwise stated. The AndHeal methodology, including the AndHeal Signal Index™ instrument, profile assignment logic, and Plan of Actions framework, constitutes proprietary intellectual property.
You may not reproduce, distribute, modify, republish, reverse-engineer, or commercially exploit any content, methodology, or output from AndHeal’s Services without prior written permission. Limited personal, non-commercial use of your individual Report is permitted as described in Section 4.
7. Limitation of Liability
To the fullest extent permitted by applicable law, AndHeal, its founder, practitioners, affiliates, and service providers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Services, including but not limited to the Assessment, the Report, any Plan of Actions, educational content, or session guidance. This limitation applies regardless of the theory of liability, whether in contract, tort, negligence, strict liability, or otherwise, and regardless of whether AndHeal has been advised of the possibility of such damages.
In no event shall AndHeal’s total aggregate liability to you for all claims arising from or related to the Services exceed the total amount you have paid to AndHeal for the specific Service giving rise to the claim during the twelve (12) months preceding the event, or one hundred dollars ($100), whichever is greater.
You acknowledge that the Services are educational in nature, that the Report is based on self-reported data processed by an AI system, and that your use of the Services is voluntary and at your own risk. AndHeal does not guarantee specific outcomes, results, or improvements from the use of its Services.
8. Indemnification
You agree to indemnify, defend, and hold harmless AndHeal, its founder, practitioners, affiliates, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from or related to:
- Your use or misuse of the Services
- Your breach of these Terms
- Your violation of any applicable law or regulation
- Inaccurate or misleading information you provided in the Assessment
- Your redistribution, misrepresentation, or unauthorized use of the Report
- Any claim by a third party arising from your sharing of or reliance on Report content
This indemnification obligation survives the termination of these Terms and your use of the Services.
9. Assumption of Risk
You expressly acknowledge and agree that your use of AndHeal’s Services, including the Assessment and Report, is at your sole risk. AndHeal provides educational information and structured insight, not guaranteed outcomes. You assume full responsibility for any decisions you make based on information obtained through the Services.
You understand that the Report is generated by an AI system based on your self-reported data, that AI-generated content may contain inaccuracies, and that the Report should not be used as the sole basis for health, performance, or lifestyle decisions.
10. Access, Modification, and Discontinuation
AndHeal reserves the right to modify, suspend, or discontinue any part of the Services, including the Assessment, at any time and without prior notice. We may update the Assessment questions, scoring methodology, report generation system, or any other aspect of the Services as our methodology evolves.
Access to the Assessment may be granted through a public URL for prospective clients or through a private link for enrolled clients. AndHeal reserves the right to restrict, suspend, or terminate access to the Services for any user who violates these Terms or uses the Services in a manner inconsistent with their intended purpose.
If you have purchased a paid Service and we discontinue it before delivery, we will provide a refund for the undelivered portion. Modifications to the methodology, content, or format of the Services do not constitute a discontinuation and do not entitle you to a refund.
11. Payment Terms
Certain AndHeal Services may require payment. Where payment is required, the terms, pricing, and payment schedule will be communicated to you before you commit to the Service. All fees are stated in US dollars and are non-refundable unless otherwise specified in writing.
If you fail to make a required payment, AndHeal reserves the right to suspend or terminate your access to the relevant Services until payment is received.
12. Privacy and Data Handling
Your use of the Services is subject to our Privacy Policy & Disclaimer, available at andheal.com/privacy-policy-disclaimer. The Privacy Policy describes what data we collect, how it is processed and stored, the platforms involved, your rights regarding your data, and the consent required before beginning the Assessment. Your completed Report is stored as a PDF within AndHeal’s own infrastructure. You may request deletion of your Report and associated data at any time by contacting [email protected].
By using the Services, you acknowledge that you have read and understood the Privacy Policy and consent to the data practices described therein. The Privacy Policy is incorporated into these Terms by reference.
13. Third-Party Services and Links
The Services may rely on third-party platforms for data storage, AI processing, email delivery, and other functions as described in the Privacy Policy. AndHeal is not responsible for the independent privacy practices, terms of service, or operational reliability of these third-party providers. Your use of any third-party service is subject to that provider’s own terms and policies.
The website may contain links to third-party websites for convenience or reference. AndHeal is not responsible for the content, accuracy, or practices of third-party sites. Accessing external links is at your own risk.
14. User Submissions and Communications
If you submit information through contact forms, email, chat, or other communications, you agree that the information provided is accurate and lawful. You may not submit content that is defamatory, unlawful, threatening, abusive, or otherwise inappropriate.
Any feedback, suggestions, or ideas you submit to AndHeal regarding the Services become the property of AndHeal and may be used without obligation or compensation to you.
15. Dispute Resolution
In the event of any dispute arising from or related to these Terms or your use of the Services, you agree to first attempt resolution through direct communication with AndHeal by contacting [email protected]. If the dispute cannot be resolved through direct communication within thirty (30) days, either party may pursue resolution through the courts as specified below.
16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
17. Modifications to These Terms
AndHeal reserves the right to update or modify these Terms at any time. Changes will be posted on this page with a revised effective date. If changes are material, we will provide notice through the email address associated with your account or through a prominent notice on the website. Your continued use of the Services after the effective date of any modification constitutes acceptance of the updated Terms.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy & Disclaimer, constitute the entire agreement between you and AndHeal regarding your use of the Services. These Terms supersede all prior agreements, representations, and understandings regarding the same subject matter. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
